OFCCP Advanced Audit Notices and Issues that lead to Penalties

OFCCP has released 2,500 Corporate Scheduling Announcement Letters (“CSALs”) to contractors that have selected for upcoming compliance reviews. 

The CSALs provide contractors scheduled audited with advanced notice. The contractor will eventually receive a “scheduling letter” that will give more details. The contractor will have 30 days to provide OFCCP the information requested in the Scheduling Letter.

Over the past several years, we have seen OFCCP Director Patricia Shiu keep her promise of ramping up the enforcement and intensity of audits.  The result has been an increase in the number of audits that have had adverse findings that have resulted in Conciliation Agreements for recordkeeping violations, financial settlements for adverse selection decisions, or disparities in a contractor’s pay practices.
